Festival strand: Legal Challenges

In an era when there is considerable pessimism about the idea of social change through the ballot box, and trust in our fellow citizens seems to have declined, the courts have taken on a greater role than ever before. The answer to almost every problem seems to be to hand the issue over to an unelected judge, whether through new forms of court order or novel interpretations of human-rights law. Even within the legal system, the role of our peers has been diminished in favour of the expert judge. Is this a welcome development, bringing cool judgement to thorny social issues, or does it signal a diminishing of democracy and ever-greater legal intervention in our lives?
